Welcome to Javisa.ai, a brand operated by Pixpod SPA ("Company", "we", "us", or "our"). By accessing or using our AI-powered booking automation platform, you agree to these Terms of Use. Please read them carefully before using our services.

1. Acceptance of Terms

By registering, accessing, or using Javisa.ai, you confirm that you have read, understood, and agreed to these Terms of Use and our Privacy Policy. If you do not agree with any of these terms, you must not use our services.

2. Description of Service

Javisa.ai is a SaaS platform that provides booking automation for service businesses. Its features include:

  • Appointment and availability calendar management
  • AI-powered booking assistant via WhatsApp and web
  • Integration with video call providers (Zoom, Google Meet)
  • Automated communications by email and messaging
  • Administration panel for businesses and professionals

3. User Accounts

3.1 Registration

To use Javisa.ai you must create an account by providing accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use at support@javisa.ai. You are solely responsible for maintaining active, compliant licenses or subscriptions with any third-party providers (such as Zoom or Google Workspace) that you choose to connect to your Javisa.ai account.

4. Acceptable Use and Messaging Conduct

By using Javisa.ai, you agree not to:

  • Violate applicable laws or regulations
  • Infringe the rights of third parties, including intellectual property rights
  • Transmit malicious, fraudulent, or deceptive content
  • Attempt unauthorized access to other users' systems or data
  • Interfere with the normal operation of the platform
  • Reverse engineer or decompile the software
  • Resell or sublicense the service without express authorization

4.1 Automated Communications

When using Javisa.ai's automated messaging features (WhatsApp, email, SMS), you agree to:

  • Only send messages to clients who have provided prior consent to receive communications from your business
  • Comply with all applicable anti-spam laws, including CAN-SPAM, CASL, and WhatsApp Business Policy
  • Not use the platform to send unsolicited commercial messages, bulk promotional campaigns without opt-in, or harassing communications
  • Ensure that all automated appointment reminders, confirmations, and follow-ups relate solely to services your clients have booked or expressed interest in

5. Third-Party Integrations

Javisa.ai may integrate with third-party services such as Zoom, Google Meet, WhatsApp Business, and others. Use of these integrations is also subject to the terms and conditions of those providers. By authorizing an integration, you grant Javisa.ai the necessary permissions to operate on your behalf within that platform.

You may revoke Javisa.ai's access to any integration at any time from your account settings or directly from the third-party platform.

5.1 Zoom Integration

When you connect your Zoom account, Javisa.ai will create, update, and delete Zoom meetings on your behalf as part of the appointment management workflow. Use of the Zoom integration is subject to Zoom's Terms of Service.

5.2 Google Workspace and Google Meet Integration

When you connect your Google account, Javisa.ai will create and manage calendar events and Google Meet links on your behalf to facilitate appointment booking. Your use of the Google integration is subject to Google's Terms of Service. Javisa.ai's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

5.3 Third-Party Service Outages

Javisa.ai is not liable for missed bookings, failed video meeting link generation, appointment delivery failures, or communication disruptions caused by outages, downtime, or policy changes from third-party providers including but not limited to Zoom, Google, WhatsApp, or AWS. Users are advised to maintain alternative contact methods for time-sensitive appointments.

6. Intellectual Property

All content, design, code, and technology of Javisa.ai are the exclusive property of Pixpod SPA or its licensors and are protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the platform in accordance with these terms.

7. User Data

You retain ownership of the data you enter into the platform. By using Javisa.ai, you grant us a license to process that data for the purpose of providing the service. Javisa.ai employs logically isolated data structures to ensure that your business data, appointment history, and client lists are strictly separated and completely inaccessible to other businesses using the platform. 8. Service Availability

We strive to keep the platform continuously available, but we do not guarantee uninterrupted availability. We may perform scheduled or unplanned maintenance and will notify you in advance when possible. Javisa.ai is not liable for damages resulting from service interruptions beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, Pixpod SPA (operating as Javisa.ai) shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the platform, including but not limited to lost bookings, lost revenue, or data loss. Our total liability shall not exceed the amount paid by you in the last three (3) months.

10. Modifications to the Service and Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective upon publication on the platform. Continued use of the service after publication of changes constitutes your acceptance of the new terms.

11. Termination

We may suspend or terminate your account, with or without notice, under any of the following circumstances:

  • Violation of these Terms of Use or our Acceptable Use Policy
  • Non-payment of applicable subscription fees after a grace period
  • Use of the platform for spam, harassment, or illegal automated messaging activities
  • Fraudulent, abusive, or harmful behavior toward other users or the platform
  • Failure to comply with applicable laws or regulations

You may cancel your account at any time from account settings or by contacting support@javisa.ai. Upon cancellation, we will delete your data in accordance with our Privacy Policy (within 90 days). Active third-party integrations (including Zoom and Google) will be disconnected, and all associated OAuth access tokens will be permanently revoked upon account termination.

12. Governing Law

These terms are governed by the laws of Chile, where Pixpod SPA is incorporated. Any dispute shall be resolved through arbitration or in the competent courts of Chile.
